Terms of Service

1. Introduction and Acceptance

Welcome to RooQuiz. These Terms of Service ("Terms") govern your access to and use of our quiz building platform and services. By accessing or using RooQuiz, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.

RooQuiz is owned and operated by JINJUN SHAO ("we," "our," or "us").

2. User Accounts

Account Registration

To use certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

Account Responsibilities

You are responsible for all content and activity in your account. You may not share your account credentials or allow others to access your account.

3. Acceptable Use Policy

Prohibited Uses

You agree not to use RooQuiz to:

  • Collect data unlawfully, or collect data you have no lawful basis to collect
  • Collect sensitive personal data — such as health, biometric or genetic data, racial or ethnic origin, religious or philosophical beliefs, political opinions, trade union membership, sexual orientation, sex life, or criminal records — without a valid lawful basis and, where required, the respondent's explicit consent
  • Invade or infringe the privacy of respondents or any other person, including collecting or exposing information about someone without their knowledge or consent
  • Run scams, phishing, or otherwise deceptive or fraudulent quizzes, or impersonate any person, business, or organization
  • Upload, publish, or distribute unlawful content, including content that is illegal, infringing, obscene, sexually exploitative, or that promotes violence, self-harm, or hatred
  • Harass, bully, threaten, stalk, defame, or otherwise harm respondents, other users, or third parties
  • Violate any data protection or privacy law that applies to you or to your respondents, including the GDPR, the UK GDPR, the CCPA/CPRA, and their local equivalents
  • Use RooQuiz for any unlawful purpose, or to plan, facilitate, or carry out illegal activity
  • Infringe the intellectual property rights of others
  • Distribute spam, malware, or viruses
  • Attempt to gain unauthorized access to our systems, or interfere with or disrupt the service
  • Use automated systems, bots, or scrapers to access the service without our permission

Your Responsibility for Lawful Data Collection

You are responsible for your quizzes and for the personal data you collect through them. In particular, you are responsible for ensuring that:

  • Your quizzes, questions, and any content you upload are lawful everywhere you distribute them
  • You have a valid legal basis for every purpose for which you collect and process personal data, and you collect only what that purpose actually requires
  • Your respondents receive a clear and accessible privacy notice telling them who you are, what you collect, why you collect it, who you share it with, and how long you keep it
  • You obtain, record, and honor consent wherever consent is the legal basis you rely on — including for marketing and for any sensitive data
  • You answer data subject requests from your respondents and handle retention, sharing, and deletion in line with the data protection laws that apply to you

When you use RooQuiz to collect quiz responses and leads, you are the data controller for that data and we act as your data processor. Our commitments as processor are set out in our Data Processing Agreement.

Enforcement

If we reasonably believe that a quiz or an account breaches this Acceptable Use Policy or applicable law, or creates legal or security risk for respondents, for other users, or for us, we may — at our discretion, with or without prior notice — remove or disable the quiz, restrict or block access to it, and suspend or terminate the account. We may act on reports submitted through our in-product reporting tools or received from respondents, and we may report unlawful activity to the competent authorities. We are under no obligation to monitor content, but we may review it.

4. Intellectual Property Rights

RooQuiz and its original content, features, and functionality are owned by RooQuiz and are protected by international copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of content you create using our platform. By using our services, you grant us a license to host, store, and display your content as necessary to provide the service.

5. Payment Terms

Certain features require a paid subscription. By subscribing, you agree to:

  • Pay all fees associated with your subscription plan
  • Provide accurate payment information through our payment processor (Paddle)
  • Authorize automatic recurring charges unless you cancel

Payment Processing

All payments are processed by Paddle.com Market Limited ("Paddle"), our Merchant of Record. Paddle is responsible for payment processing, tax calculation, and compliance. By making a purchase, you agree to Paddle's Terms of Use and Privacy Policy.

Refunds and Cancellation

You may cancel your subscription at any time through your account settings or by contacting us. Cancellations take effect at the end of the current billing period, and you will retain access until that date.

Refund requests must be submitted within 14 days of purchase. Refunds are available if:

  • You have not used the service extensively (less than 10% of features accessed)
  • There is a technical issue preventing you from using the service
  • You were charged in error

Refund requests are reviewed on a case-by-case basis and processed within 5-10 business days if approved. Refunds are issued to the original payment method.

6. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the service at any time. We are not liable for any modification, suspension, or discontinuation of the service.

7. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the service will cease immediately.

You may terminate your account at any time by contacting us or through your account settings.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the service will be uninterrupted, secure, or error-free, or that defects will be corrected.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOQUIZ SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration or in courts of competent jurisdiction.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the service after changes constitutes acceptance of the modified Terms.
